Coca-Cola® is certainly an example of a mark so strong that it is highly unlikely that any other person or company would ever be permitted to use that mark in connection with any sort of goods or services sold anywhere in the world. The strength of such a mark, however, is not granted to its owner by any particular provisions of the trademark laws. Rather, such strength is vested in the trademark by virtue of its use in the market, by its acquired commercial identity in the market, and by the common-sense application of the spirit of trademark law to the real, dynamic flow of commerce.
