There are always exceptions that prove the rule, and federal statutes are not exempt from the rule of exceptions. The trademark depicted above, for example, having the description, "the mark consists of a wavy Italian flag with 'Roseli' superimposed on top of the flag and a decorative flourish beneath the letter 'o'," is a regisitered trademark of JP Foodservice, Inc. Although neither the drawing in the registration nor the description indicates the green, white, and red colors of the Italian national flag, nothing prevents the flag being colored, and the description is certainly specific about which national flag is represented. Likewise, duly registered trademarks and service marks can be found to represent exceptions to each of the several statutory prohibitions from trademark registration.
